Terms of Service

1. Acceptance

By downloading, installing, or using GapSpark (the “App”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the App.

2. Service description

GapSpark analyzes publicly available App Store reviews to surface user pain points and helps users generate app concepts. Some features require a free Sign in with Apple account. The App is provided “as is” without warranties of any kind.

3. Eligibility

You must be at least 13 years old (or 16 in the EU/UK) to use the App. By using the App, you represent that you meet this requirement.

4. Your account

If you sign in, you are responsible for maintaining the security of your Apple ID. We are not liable for any loss or damage from unauthorized access to your Apple ID. You may delete your account at any time by revoking access through iPhone Settings.

5. Acceptable use

You agree not to:

• Attempt to reverse engineer, scrape, or abuse the backend API
• Circumvent rate limits (3 Deep Dives per day on the free tier)
• Use the App to violate any law or infringe anyone's rights
• Upload malicious code or attempt to compromise our systems
• Resell, sublicense, or redistribute content generated by the App without attribution

6. AI-generated content

The App uses multiple AI systems (Cloudflare Workers AI, Anthropic Claude, Apple Foundation Models) to generate pain point summaries, app ideas, and development prompts. AI-generated content:

• May contain errors, biases, or inaccuracies
• Should not be relied upon as professional business, legal, or technical advice
• Is provided for your inspiration and research; you are responsible for validating any idea before building it

Market opportunity assessments, competitor analyses, and revenue estimates are heuristic and informational only.

7. Intellectual property

The App, its design, code, and brand are owned by AI AutoSite. The open-source portions of the codebase (see our GitHub) are licensed under the MIT License.

App ideas generated by the App's AI features are yours to use freely — you own what you build.

App Store review data analyzed by the backend is sourced from Apple's public RSS feeds and remains the property of the respective reviewers and Apple Inc.

8. Third-party services

The App relies on third-party services including Apple (Sign in with Apple, App Store), Cloudflare (backend hosting), and Anthropic (Claude API). Your use of these services through the App is also governed by their respective terms.

9. Service availability

We strive to keep the App available 24/7, but we do not guarantee uninterrupted service. Scheduled maintenance, third-party outages, or unforeseen events may cause temporary unavailability.

10. Free tier and limits

Currently, all features of the App are free, with the following limits:

• Deep Dive: 3 analyses per day per user
• Other limits may be added in the future to manage costs

We reserve the right to introduce paid tiers or modify limits with advance notice.

11. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AI AUTOSITE AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU HAVE PAID US (WHICH IS CURRENTLY $0 FOR THE FREE TIER).

13. Indemnification

You agree to indemnify and hold AI AutoSite harmless from any claims, damages, or expenses arising from your misuse of the App or violation of these Terms.

14. Changes

We may update these Terms as the App evolves. Material changes will be announced via the App and the effective date above. Continued use after changes constitutes acceptance.

15. Termination

You may stop using the App and delete your account at any time. We may suspend or terminate accounts that violate these Terms.

16. Governing law

These Terms are governed by the laws of Japan, without regard to conflict-of-law principles. Disputes will be resolved in the courts of Fukuoka, Japan, unless local consumer-protection law in your jurisdiction entitles you to different treatment.
